2014 Notification of Rules 51 & the new 52 and their Effective Dates

The federal Office of Special Education Programs revised the federal regulations implementing
the Individuals with Disabilities Education Act (IDEA). In order to make the federal and state
regulations consistent it was necessary to revise portions of Rule 51 and to develop a new Rule
52 containing regulations related to the provision of early intervention services to infants and
toddlers (below age three) with disabilities. Public hearings were held on December 9 and 10,
2013. The State Board of Education approved the changes at the January 2014 meeting. The
rule was then forwarded to the Attorney General’s Office and the Governor for review and
approval. Both the Attorney General and the Governor have approved the rule and the
revisions became effective on July 15, 2014.

New Rule 52 was developed to include regulations regarding the provision of early intervention
services to infants and toddlers with disabilities. The language in Rule 52 contains those
requirements which are the responsibility of resident school districts. Language regarding the
responsibility of services coordinators remains in the Nebraska Department of Health and
Human Services regulations (DHHS Manual 480 NAC 3 currently in the final stages of the
revision process).
